We are registered under the Companies Act 2006 as a private company with its registered offices in England. The general terms of sales are intended to govern all transactions involving sales of products and services to any customer, be it a natural or legal entity, whether the customer is a professional or non-professional individual (called a customer) who has made a purchase through a call/email/message. These terms and conditions aim to generate a contractual framework between the customer and the Mobile Tyre Fitter Company.

The terms and conditions are said to govern all the sales conducted by Mobile Trye Fitter Company and to develop an individual contract between us and the customers. 

 

The terms and conditions take precedence and supersede any prior agreements, contracts, commitments, declarations, promises, intentions, documentation, and information that has been exchanged with the customers regarding the orders.

 

The customer’s order gets accepted as soon as the customer calls or messages us and requests us for our emergency tyre services. You may place an order through our application as well. This is followed with the completion of the order by reviewing the details thoroughly, including price and address, and rectifying the errors that appear in the details before providing a complete acceptance.

 

The terms and conditions are accessible through our website and are also provided to the customer in a lasting format attached with the acknowledgement of receipt. 

 

The contract is established as soon as the acknowledgment of receipt is generated by our company. 

 

We make sure that you have access to a written contract for a period of ten years from the order’s delivery. 

 

The customer is notified once entered into the contract and it implies an obligation to pay the price in favor of the company.

Mobile Tyre Fitter is a provider of emergency tyre services in the UK, committed to delivering its services within a timeframe ranging from 90 minutes to 2 hours from placing the order or payment deduction by the company. The time may increase depending on your location in the UK and your request for specific brand tyres in the mid-range and premium categories. 

 

Mobile Fitter Tyre products include budget tyres, mid-range tyres and premium tyres. The information forms the contractual obligation by the seller that the customers agree upon at the end of the contract. The contract is contingent upon the availability of the products.

3.1: Access to Seller’s Website 

 

Mobile Tyre Fitter’s website is public, and all visitors can access it year-round, seven days a week, 24 hours a day. The website may be down occasionally for the purpose of maintainace that may arise due to some technical errors. Any technical errors that are beyond our control might need additional time to restore access to the website.

 

Our website is easy to navigate and use. You can place an order instantly by calling our representatives on the numbers provided, or you may use our application or you may email us to get an immediate response.

3.3: Call/Message or Email For The Order 

 

Once you call us (0800 058 4151), email us ([email protected]),  WhatsApp us (07518 886721), use our mobile application, your order will be processed after your confirmation. The order is confirmed and processed once the payment is released from the payment channels. You’ll immediately receive an email from us in your inbox. 

 

Once you confirm your order, you’ll basically register with us by providing your (1) Full Name, (2) Mobile Number, (3) Vehicle Details (such as make, model, year), (4) Exact Tyre Size, (5) Number of Tyres Needed, (6) If wheel locking nut key required, (7) Postal Code of Your Current Car Location, (8) Car Reg # and (10) Payment Information. The information has to be correct and accurate. 

 

We have all the rights to refuse access to its services or change eligibility criteria at its discretion.  By registering, you affirm that you are of legal age to enter into a contract, or if you register on behalf of a legal entity, the latter is authorised to all liabilities associated with the contract.

 

3.4: Information Accuracy Is Needed 

 

You are solely responsible for providing us with accurate information. Any inaccuracies may result in us taking legal action for inaccuracies. It is your responsibility to provide the correct information regarding your tyre size and postal code. Failure to do so may result in a call-out charge from the seller.

 

You must inform us if you are missing your wheel locking nut key. Otherwise, we will assume that you possess it. In the event that our fitters need to break the wheel locking nut to install the new tyre, an additional charge will be incurred.

 

3.5: Right Order 

 

It’s crucial for customers to specify their preferred type of product, whether they require a mid-range tyre, budget tyre, or premium tyre. If no preference is communicated, the seller will default to providing a mid-range or budget tyre.

3.7: Service Timeframe 

The emergency tyre service is provided within a timeframe of 90 minutes to 2 hours after the payment is deducted from the customer’s accounts. The time needed for services in remote areas far from the main city of the UK may increase. It may also increase if the customer requests for a certain brand tyre in a premium range. 

 

3.8: Cancellation 

 

After payment for our products and services, cancellation is only permissible within a five-minute window. Past this timeframe, a deduction of £50 will be applied to the total payment received, starting from the fifth minute and one second of the cancellation. This strict cancellation policy has been implemented because we are an emergency tyre fitter company, and every cancellation comes with a cost to us. 

 

  1. Financial Conditions

 

The policy outlines different payment methods accepted by the seller. We accept payment through cards, Paypal and bank transfers. Payment by cards is protected by a secure payment provider. The card information is never stored or printed backend for unauthorised use. The payment method is secured with a 3D secure protocol to protect sensitive data.

 

The credit card payments are immediately debited, and the action is irrevocable. The customers give us the authority to debit their cards for the indicated amount, confirming them as legal card holders. Paypal payments are also protected with a 3D secure protocol. Transfer through the bank is also possible and is made in our registered bank account with the specific details provided. It is crucial for customers to include the order number in the transfer reference for a record.

 

  1. Ownership of The Product 

Upon validation of the order, the tyres now become the sole property of the customer.  All risk of loss or damage to the product after delivery lies with the customer after the transfer of ownership. This is immediately done once the payment is deducted and the product is delivered.

At Mobile Tyre Fitter, we assure you of the quality and performance of our placed tyres, which come with a comprehensive warranty. 

 

Warranty Coverage:

1. Limited Treadwear Warranty: Our tyres offer a limited treadwear warranty. If your Tyree wears prematurely under normal driving conditions within the warranty period, we offer a replacement after a careful evaluation. This condition is not applicable for rash driving, potholes, and self-damage to the placed tyres.

2. Workmanship Warranty: We stand behind our emergency tyre service and provide you with error-free workmanship. If you find any loopholes in the delivery, you may contact us. 

 

Warranty Exclusions:

 

1. Damage resulting from neglect and misuse. 

2. Damage arising from the use of tyres for commercial purposes or racing. 

3. Cosmetic or sidewall damage not affecting the tyre performance

4. tyres that are repaired or altered by unauthorised individuals. 

 

 

Claim Process:

To initiate a warranty claim, please present your original proof of service. Our fitters will promptly assess the tyres and will process the claim. You may send the tyre to our address, and we will evaluate it for the faults. If the fault lies with us, your shipping and tyre costs will be reimbursed later.

 

 

  1. Limitation of Liability 

Suppose one party doesn’t fulfil their obligations in the contract unless their failure to perform is considered final. In that case, they’ll only have to pay damages if they were previously notified to do so within a reasonable time. The party responsible might have to pay damages for not fulfilling their duties or for delays unless they can prove that something beyond their control stopped them. They’re only responsible for damages that were easy to predict when the contract was made, except in cases of gross negligence or fraud. Even then, they’re only responsible for the direct and immediate harm caused by not fulfilling their obligations.

 

  1. Force Of Majeure

If a force majeure event causes a permanent obstacle for one party, the contract ends automatically, and both parties are freed from their responsibilities.

 

If a force majeure event causes a temporary obstacle, the obligation’s execution is paused unless the resulting delay is significant enough to justify terminating the contract.

If a party cannot fulfil their contractual obligation due to force majeure, they are freed from their responsibility to the extent that the obstacle is caused by force majeure and is permanent unless they have agreed to handle it or have been previously notified.
